Welcome to Cupindy ("Cupindy," "we," "us," or "our"). These Terms & Conditions (“Terms”) govern your access to and use of the Cupindy website cupindy.com (“the Site”), mobile services, and all products and services offered through our platform.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.

1. Country of Residence & Governing Law

Cupindy operates from Egypt and primarily serves customers within Egypt.
These Terms are governed by the laws of the Arab Republic of Egypt.
Any disputes arising from the use of our services shall fall under the exclusive jurisdiction of Egyptian courts.

2. Nature of Cupindy’s Service (Marketplace Model)

Cupindy operates as an online marketplace platform that enables customers to browse, order, and purchase products offered by independent suppliers (“Suppliers”).
Unless explicitly stated otherwise, Cupindy is not the manufacturer, owner, or producer of the products displayed on the Site.

Cupindy’s role includes:

Displaying and marketing products on behalf of Suppliers
Facilitating order placement and payment processing
Providing warehouse handling, inspection, and order fulfillment services
Collecting customer payments on behalf of Suppliers
Charging Suppliers service fees and commissions for marketing and facilitation services

Cupindy’s revenue is limited to service fees only.

Amounts collected from customers do not represent product sales revenue of Cupindy, as the ownership of goods remains with the Supplier until delivered to the customer.

3. Product Information and AI-Generated Content

To enhance user experience, Cupindy may use AI tools to assist in creating product descriptions, titles, images, and support content.

We clarify that:

Product data originates from Suppliers.
AI tools may be used to enhance clarity or generate supplementary imagery.
Actual product specifications may vary slightly depending on Supplier-provided information.
Cupindy inspects items before shipping to verify accuracy and quality.

Customers are encouraged to contact us if they identify any incorrect, missing, or unclear information.

4. Consignment & Fulfillment Handling

Some Suppliers may provide Cupindy with inventory temporarily for storage and fulfillment (“consignment stock”).
Such items remain the property of the Supplier at all times, and Cupindy handles them solely for the purpose of order fulfillment.

Cupindy is not liable for Supplier delays, discontinuation, unavailability, or changes in product specifications.

5. Ordering & Payment

To place an order, customers must provide accurate personal information including name, address, phone number, and payment details.

Payment Collection

Payments made by customers—whether electronically or via courier collection—are received by Cupindy solely in its capacity as a collection agent for Suppliers.

Cupindy may deduct its service fees and remit the remaining balance to the Supplier.
Cupindy is not responsible for Supplier pricing decisions.

6. Order Amendments & Cancellations by Cupindy

Cupindy reserves the right to cancel or amend orders at its sole discretion in cases including, but not limited to:

Incorrect or incomplete product information
Inventory mismatch
Defective item detected during quality inspection
Invalid or incomplete shipping address
Customer refusal of previous orders
Operational concerns or security issues

If an amendment occurs, the affected item will be removed and the customer will be notified via email or SMS, where applicable.

7. Shipping & Delivery

Shipping times vary depending on location.
We aim to deliver within:

1–3 working days inside Cairo, Giza, Helwan, and 6th of October
1–5 working days for all other cities

Working days: Monday–Thursday and Saturday
Non-working days: Friday, Sunday, and national holidays

8. Returns, Exchanges & Refunds

Please refer to the Return & Refund Policy for full details. Key points include:

Returns accepted when:

Product is unused, sealed, and in original condition
Wrong or defective item is received
Return request is made within the applicable return window

Refund Processing:

Refunds are issued through the original payment method.
A 3% handling fee applies for card payment refunds.

9. Warranty

Warranty coverage, duration, and responsibility belong to the brand or Supplier.
Cupindy assists customers in communicating warranty claims but is not the warranty provider.

10. User Responsibilities

Customers agree to:

Provide accurate and complete data
Not misuse the Site
Not attempt unauthorized access or interference

Users are responsible for maintaining the confidentiality of their account information.

11. Supplier Responsibility

Suppliers are solely responsible for:

Product authenticity
Safety and compliance
Accurate information provided for listings
Guaranteeing product quality
Honoring applicable warranties

Cupindy is not liable for Supplier-provided inaccuracies.

12. Intellectual Property

All content on the Site—including text, images, graphics, and software—is owned by Cupindy or licensed to Cupindy.
Unauthorized use is strictly prohibited.

13. Limitation of Liability

To the fullest extent permitted by law, Cupindy is not liable for:

Losses resulting from use or inability to use the Site
Misuse of products by customers
Delays caused by Suppliers, couriers, or external factors

14. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and process your personal data.

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation.
If unresolved, disputes will be handled exclusively by Egyptian courts.

16. Modifications to Terms

Cupindy may update these Terms at any time.
Your continued use of the Site constitutes acceptance of the updated Terms.
